Educational Support Services Agreement

This agreement ("Agreement") is concluded on #date# between :

Hereinafter referred to as the “Beneficiary”.

Objective of the Agreement

1.1 The purpose of this Agreement is to establish a partnership whereby the Provider shall provide:

Educational support services.

Obligations of the Provider

2.1 The Provider shall bear the following responsibilities:

Identify suitable universities for Beneficiary.
Assist the Beneficiary in the application process for university admission.
Provide the necessary support and guidance throughout the application process.
The Provider undertakes to provide the services in accordance with the highest standards of quality and accuracy, and in the event that the Provider fails to do so due to an error or negligence on its part, the Beneficiary shall be entitled for a free extra submission to a different university or a college.

Beneficiary's Obligations

3.1 The Beneficiary shall undertake to:

Provide accurate and complete information to the Provider regarding the requirements of studies.
Provide the necessary documents, including certifications, attestations and translations.
"The Beneficiary shall undertake to carefully review all applications submitted to the Provider and ensure that they comply with the requirements of the relevant universities and bodies. In the event of failure, the Provider shall not bear any additional costs to correct the error."

Fees and Payments

The total cost of the educational support service for each beneficiary candidate is as follows:

Services within Romanian territory:

The payment of the sum total for the above chosen services should be paid as the following:
- 50% as a downpayment upon signing this contract
- 50% as a final payment after the issuance of the university admission approval.

Term and Termination of Agreement

5.1 This Agreement shall commence on the Effective Date and shall remain in effect until terminated in accordance with its terms.

5.2 Either party may terminate this Agreement by giving 10 days written notice to the other party.

5.3 All Services shall be paid in advance.

5.4 All Services shall be non-refundable.

Intellectual Property Rights

6.1 Each party shall retain its own intellectual property rights.

Confidentiality

7.1 Each party shall maintain the confidentiality of all information relating to the other party.

The Provider undertakes to maintain the confidentiality of all information provided by the Beneficiary, with the right of the Provider to use the information for marketing and advertising purposes only."

Dispute Resolution

8.1 Any disputes arising from or related to this Agreement shall be subject to the laws of Romania.

8.2 Disputes shall be resolved through negotiation, and if no solution is reached, disputes shall be referred to the Romanian judiciary.

Refunds

The Beneficiary has the right to refuse to pay the second payment in the event that the application is rejected by the Romanian Ministry of Education for reasons such as: missing documents, error in submitting the application.
No Refunds will be provided by the provider to the beneficiary once the contract is signed.
All services provided by the provider are non-refundable.

Compensation and Penalties

In the event of the Provider's failure to submit the application to the Romanian universities or private bodies, the provider undertakes to bear all material costs paid by the beneficiary.

Miscellaneous Clauses

The Provider undertakes to provide periodic reports explaining the status of the submitted applications, the progress made, and any possible problems or delays, with clear solutions for the Beneficiary.

Entire Agreement

12.1 This Agreement represents the entire agreement between the Parties and supersedes all prior or contemporaneous communications, representations or agreements, whether oral or written.
